Terms of Service

Please read these terms carefully before using our commercial painting services.

1. Agreement Overview

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Commercial Painting Contractors Dallas ("Company," "we," "us," or "our"). By requesting our services, submitting a quote request, or engaging our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services or submit any requests.

2. Services Description

Commercial Painting Contractors Dallas provides professional commercial and industrial painting services, including but not limited to:

  • Interior and exterior painting
  • Specialized coatings and finishes
  • Surface preparation and repairs
  • Project management and consultation
  • Color consultation and specification
  • Quality assurance and inspection

All services are provided in accordance with industry standards and local building codes.

3. Quotes and Pricing

Estimates

All quotes provided are estimates based on the information available at the time of quotation. Final pricing may vary due to:

  • Changes in project scope or specifications
  • Discovery of unforeseen conditions
  • Material price fluctuations
  • Additional work requested during the project
  • Permits or regulatory requirements

Payment Terms

Payment terms are as follows:

  • 50% deposit required to schedule work
  • Progress payments may be required for projects over $10,000
  • Final payment due upon substantial completion
  • Late payments may incur interest charges of 1.5% per month
  • All payments are due within 30 days of invoice date

4. Project Timeline and Scheduling

Project timelines are estimates and may be affected by various factors including weather conditions, material availability, unforeseen site conditions, and client-requested changes. We will make reasonable efforts to meet agreed-upon schedules.

Delays caused by circumstances beyond our control, including but not limited to acts of God, weather conditions, material shortages, or client delays, shall not constitute a breach of contract.

5. Client Responsibilities

As a client, you agree to:

Site Access and Preparation

Provide clear access to work areas and ensure proper site preparation before work begins.

Permits and Approvals

Obtain all necessary permits and approvals required for the project.

Communication

Provide timely decisions and approvals to maintain project schedule.

Utilities

Ensure utilities are available as needed for the work.

Protection of Property

Remove or protect valuable items from work areas.

6. Warranties and Guarantees

Workmanship Warranty

We warrant our workmanship for a period of two (2) years from completion. This warranty covers defects in workmanship that are not caused by normal wear and tear, abuse, or improper maintenance.

Material Warranties

Material warranties are provided by the manufacturer and are subject to their specific terms and conditions. We will assist in processing manufacturer warranty claims when applicable.

Limitations

Warranties do not cover damage caused by settlement, structural movement, moisture intrusion, environmental factors, or modifications made by others. Warranties are void if payment terms are not met.

7. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claims arising from or related to our services shall not exceed the total amount paid for the specific project in question.

We shall not be liable for consequential, incidental, special, or indirect damages, including but not limited to lost profits, business interruption, or property damage beyond the scope of our work.

8. Insurance and Safety

We maintain appropriate insurance coverage including general liability and workers' compensation insurance. Our employees follow strict safety protocols and comply with OSHA regulations.

We recommend that clients maintain appropriate insurance coverage for their property during construction projects.

9. Termination

Either party may terminate this agreement with written notice. In the event of termination:

Client Termination

Client shall pay for all work completed and materials purchased up to the termination date.

Company Termination

We may terminate if payment terms are not met or if unsafe working conditions exist.

10. Dispute Resolution

Any disputes arising from this agreement shall first be attempted to be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in Dallas County, Texas, in accordance with the rules of the American Arbitration Association.

This agreement shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

11. Force Majeure

Neither party shall be liable for delays or failures in performance due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, strikes, government regulations, or material shortages.

12. Intellectual Property

All designs, specifications, and project documentation prepared by us remain our intellectual property unless otherwise agreed in writing. Client grants us permission to use project photos for marketing purposes unless specifically prohibited.

Client represents that they have all necessary rights to use any designs, trademarks, or materials provided to us.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes are posted constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with any written agreement or proposal, constitute the entire agreement between the parties and supersede all prior understandings, agreements, or representations.
